Terms of service

The deal, in plain language.

These terms are the agreement between you and MonkeySee Inc., of San Francisco, California, for using Unsure. Jev is made by TypeSafe Inc., which is not a party to this agreement. By creating an account, calling the API, or installing an SDK against our hosted service, you agree to them. If you are using Unsure for a company, you are agreeing on its behalf.

1. The service

Unsure (“the Service”) is a hosted platform for making structured classification decisions on the Jev model, recording each decision with its confidence, reviewing and correcting those decisions, replaying prompts against corrected decisions, and running pipelines that combine Jev with third-party image, video and text models. The Service includes the application at app.unsure.dev, the API, and the official SDKs.

We may change the Service over time. We will not remove a capability you have paid credit to use without giving you notice and a reasonable way to use or recover that credit.

2. Accounts

  • You must be at least 18, or the age of majority where you live, and able to form a binding contract.
  • Keep your password and API keys secret. Anything done with your keys is done by you, until you revoke them or tell us they were compromised.
  • Give us an accurate email address. It is how we reach you about billing, security and changes to these terms.
  • Every account in a deployment shares one workspace. Do not invite people into your workspace whom you would not want to see every decision in it.

3. Your content

You own the prompts, schemas, records, media, corrections and anything else you send to the Service (“Content”), and the outputs the Service returns for them. You give us a limited license to store, process, transmit and display your Content only as needed to provide the Service to you, including sending it to the model providers named in our privacy policy. That license ends when the Content is deleted, except for backups that expire on their own schedule.

You are responsible for having the right to send us your Content. If it includes personal data about other people, you are responsible for having a lawful basis to process it and for telling them what you need to.

We do not train models on your Content.

4. Acceptable use

Do not use the Service to:

  • Break the law, or help someone else break it.
  • Make decisions about people that the law says need a human, or that are unlawful to automate, without the human oversight the law requires.
  • Send Content you do not have the right to send, including other people's secrets or protected health, financial or biometric data where a specific agreement is required and we have not signed one.
  • Probe, overload, scrape or reverse engineer the Service, or circumvent rate limits, credit checks or authentication.
  • Resell access to Jev or the third-party models through the Service without our written agreement.
  • Use the Service to build a product whose primary purpose is to compete with Jev by extracting its behavior.

We can suspend an account that we reasonably believe is doing any of these, and we will tell you why unless the law or the safety of others prevents it.

5. Credits and payment

  • Every account receives starter credit. Beyond that, the Service is prepaid: you buy credit in the packs shown on the pricing page and usage draws it down.
  • Every credit purchase carries a platform fee of 5% of the credit amount, shown as a separate line at checkout and on your receipt. The fee buys no credit and is not refundable.
  • Prices are in US dollars and exclude any taxes we are required to collect. Current rates are published on the pricing page and may change; a change never affects credit you have already bought.
  • Credit does not expire. It is not transferable between accounts and has no cash value except as described here.
  • Credit purchases are final. Credit is not refundable, except where the law requires otherwise.
  • When the balance reaches zero, requests that would cost money are rejected until you top up. Your Content is not deleted.
  • Payments are processed by Stripe under its own terms. Disputing a charge with your card issuer instead of contacting us may result in suspension while we sort it out.

6. Models and outputs

Jev is provided by TypeSafe. Encoder and decoder models are provided through OpenRouter by the providers you select. Outputs are probabilistic. They can be wrong, and the whole point of the Service is to find out how often. You are responsible for how you act on an output, for keeping a human in the loop where that is appropriate, and for complying with the terms of any third-party model you choose to route Content through.

7. API and SDKs

The SDKs are published under their own open-source licenses, which govern your use of that code. Use of the hosted API is governed by these terms. We may enforce rate limits and request size limits, which are documented, and we may change them with notice. Do not share one API key across unrelated systems; create a named key for each so it can be revoked on its own.

8. Ending the agreement

You can stop using the Service at any time and ask us to delete your account. We can end the agreement if you breach it and do not fix the breach within 14 days of our notice, or immediately for a breach that cannot be fixed. Either way, sections 3, 9, 10 and 11 survive. On termination we will, on request, give you an export of your Content within 30 days before deleting it.

9. Disclaimer

The Service is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not promise that any output is accurate, that any model will remain available, or that the Service will be uninterrupted or error-free.

10. Limitation of liability

To the fullest extent the law allows, neither MonkeySee Inc. nor its officers, employees or suppliers will be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising out of or related to the Service, even if advised of the possibility. Our total liability for all claims arising out of the Service in any twelve month period is limited to the amount you paid us in that period, or one hundred US dollars, whichever is greater. Some jurisdictions do not allow these limits, in which case they apply to the extent permitted.

11. Indemnity

You will defend and indemnify MonkeySee Inc. against third-party claims arising from your Content, your use of the Service in breach of these terms, or decisions you make or actions you take based on outputs, including reasonable legal fees. We will tell you promptly about any such claim and let you control the defense, provided you do not settle in a way that admits fault on our behalf without our consent.

12. Governing law and disputes

These terms are governed by the laws of the State of California, United States, without regard to its conflict of laws rules. Any dispute that we cannot resolve by talking will be brought in the state or federal courts located in San Francisco County, California, and both of us consent to their jurisdiction. If you are a consumer in a jurisdiction whose law gives you the right to sue at home, nothing here takes that away.

13. Everything else

  • These terms, the privacy policy and the pricing page are the whole agreement between us about the Service and replace any earlier one.
  • If a court finds part of these terms unenforceable, the rest still applies.
  • Our not enforcing a term today does not mean we cannot enforce it tomorrow.
  • You may not assign this agreement without our consent. We may assign it to a successor to our business.
  • Notices to you go to your account email. Notices to us go to hello@unsure.dev.
  • When we change these terms we update the date at the top, and for material changes we email you at least 14 days before they take effect. Continuing to use the Service after that date means you accept them.
